Amendments to Federal Rules and Forms Effective December 1, 2018

Information regarding amendments to the Federal Rules and Official Bankruptcy Forms effective December 1, 2018 is available on the United States Court's website.

Pending Changes in Bankruptcy Forms

The following changes will be made to our Court’s CM/ECF System on December 1, 2018.
Rule 3002.1 Claim Supplements (Fed. R. Bankr. P. 3002.1(b)(1))

Notice of Payment Changes that arise from a home-equity line of credit (HELOC) should be filed in the same manner as Notice of Payment Changes that arise from a mortgage.  

For Creditors, use the Rule 3002.1 Claim Supplement program and the radio button option for Supplement 1 – Notice of Mortgage Payment Change (also includes HELOCS).

For ECF filers, use the appropriate event located in the 3002 Claim Supplements menu in CM/ECF.  Use either Notice of Mortgage Payment Change – Rule 3002.1 (also includes HELOCS)or Notice of Mortgage Payment Change NO POC Filed – Rule 3002.1 (also includes HELOCS).

The following two events will also be added for ECF filers.

  1. Motions/Applications > Determine Validity of Payment Change (Rule 3002.1 event) – Added for use by parties to object to a payment change. (Fed. R. Bankr. P. 3002.1(b)(2))
  2. Appeal > Supplemental Statement by a Party re: Certification of Direct Appeal – Added for use by parties to file a short supplemental statement regarding the merits of the certification. (Fed. R. Bankr. P. 8006(e)(2))
