Sunset of Certain Provisions of the Consolidated Appropriations Act

Friday, February 18, 2022

1.   Sunset of Certain Provisions of the Consolidated Appropriations Act:

Several bankruptcy provisions of the Consolidated Appropriations Act expired on December 27, 2021.  A bill passed the U.S. Senate on December 20, 2021 to extend the deadlines; however, the U.S. House of Representatives has not taken up the legislation.  Consequently, effective immediately, the following events are no longer available for filing in the Court's Case Management/Electronic Case Filing ("CM/ECF") system:

       a.   Bankruptcy Events → Motions/Applications → Discharge Pursuant to Section 1328(i)
       b.   Bankruptcy Events → Claim Actions → Supplemental Proof of Claim for CARES Forbearance Claim

2.    Local Form 4004-1 Certification and Request for Issuance of Discharge:

The United States Bankruptcy Court for the Northern District of Oklahoma has revised Local Form 4004-1 (Chapter 13) Certification and Request for Issuance of Discharge.  The form was revised to remove the changes previously made for the Consolidated Appropriations Act.  The revised form is now available on the Local Forms page of the Court's website at:  https://www.oknb.uscourts.gov/forms/local-form-4004-1-chapter-13-certification-and-request-issuance-discharge.
