1.  Adoption of Interim Bankruptcy Rules Approved for the Uniform Implementation of the Small Business Reorganization Act of 2019

On January 9, 2020, the United States Bankruptcy Court for the Northern District of Oklahoma (the Court) entered General Order 20-GO-01 adopting Interim Bankruptcy Rules (Interim Rules) for the uniform implementation of the Small Business Reorganization Act of 2019 (SBRA).

The Interim Rules are effective as of February 19, 2020, and remain in effect until further order of the Court. Click here to view 20-GO-01.

2.  Amendments to Official Forms Effective February 19, 2020

Eight Official Forms have been amended and two new Official Forms have been created to implement SBRA. 

Amended Official Forms:  101, 201, 309E, 309F, 314, 315, 425A, and Director’s Form 2000.
New Official Forms:           309E2 and 309F2

3.  CM/ECF System Unavailable February 19, 2020 from Midnight to 2:00 AM

The Court’s CM/ECF system will be unavailable on Wednesday, February 19, 2020, from 12:00 AM until 2:00 AM (CST) in order to upgrade the system to conform to the requirements of SBRA.  During this time, e-filers will not be able to file electronically. 

4.  CM/ECF Changes for SBRA

Filers should be aware of the following changes in CM/ECF for SBRA.

Case Opening
(Ch. 11 Cases):

 

When opening a Ch. 11 business case, filers will now receive three options to select from regarding the debtor's small business status.

  • No, I am not a small business debtor.
  • Yes, and I do not choose to proceed under Subchapter V of Chapter 11.
  • Yes, and I choose to proceed under Subchapter V of Chapter 11.

The selection on this screen shall correspond with the selection on the debtor’s petition (i.e., #13 on Official Form 101 and #8 on Official Form 201).

Debtor’s Election of Small Business Designation (in an Involuntary or Converted Case):

The docket event Miscellaneous/Other > Debtor’s Election of Small Business Designation shall be used by an involuntary debtor or a debtor whose case is converted to Ch. 11 to elect to proceed as a small business debtor and to elect whether to proceed under Subchapter V. 

Pre-Conference Status Report (SubchapterV):

The status report mandated by 11 U.S.C. § 1188(c) shall be filed by the debtor using the docket event Miscellaneous > Pre-Conference Status Report (Subchapter V).
Ch. 11 Plan (Subchapter V): The plan mandated by 11 U.S.C. § 1189 shall be filed by the debtor using the docket event Plan > Chapter 11 Small Business Plan.
